1. IDENTIFICATION

Ludium Lab, S.L. (hereinafter "Ludium") is the company owner of the Sora Stream platform and service (hereinafter "Sora Stream"), with registered officer at C/Llauder 1, Entlo 1 08003 Barcelona, Spain, and registered in the Mercantile Registry of Barcelona and NIF B65785099. 2. LEGAL INFORMATION AND ACCEPTANCE OF THE SORA STREAM TERMS OF USE

These End-User License Agreement (EULA), hereinafter "Terms of Use", regulate the use of the Sora Stream platform that Ludium makes available to users so they can fully enjoy the latest streaming games included on the Sora Stream platform.

The access and/or use of the Sora Stream services implies full and unconditional acceptance of the Terms of Use published by Ludium at the time of access and/or use of the platform. By accepting these Terms of Use, the User represents and warrants that they are at least eighteen (18) years of age and have full legal capacity to enter into a binding agreement, or, where the User is a minor, that a parent or legal guardian has accepted these Terms of Use on the minor's behalf and assumes full responsibility for the minor's use of the Service in accordance with Section 3. The User will be liable for damages of any kind that Ludium may suffer directly or indirectly as a result of any breach of these Terms of Use and the applicable regulations.

3. USERS

Access and/or use of the Sora Stream platform gives the condition of USER to the person, who accepts, from such access and/or use, the Terms of Use reflected here.

The subscription to, and contracting of, the Sora Stream Service is exclusively reserved to natural persons who are eighteen (18) years of age or older and who have full legal capacity to enter into binding agreements. By subscribing to or purchasing any Paid Subscription, the User represents and warrants that they are at least eighteen (18) years of age.

Notwithstanding the foregoing, minors under eighteen (18) years of age may use the Sora Stream platform, provided that:

  1. A parent or legal guardian has previously subscribed to the Service and accepted these Terms of Use on the minor's behalf;
  2. Such parent or legal guardian expressly authorizes the minor to use the platform and assumes full responsibility for the minor's use thereof, including compliance with these Terms of Use; and
  3. The minor's use of the platform is carried out under the supervision and control of such parent or legal guardian.

The parent or legal guardian who authorizes a minor to use Sora Stream shall be jointly and severally liable with the minor for any breach of these Terms of Use, any damage caused to Ludium or to third parties, and any purchases or transactions carried out through the minor's account.

Please, make responsible use of the time you spend playing Sora Stream.

4. INFORMATION PROVIDED BY SORA STREAM USERS

To check-in and create an account, users must provide personal registration information to use the Sora Stream service, such as the username, email or image to create an avatar. For more information, please visit our Privacy Policy.

The user agrees that Ludium can use technology and integrated services to allow this information to be used to carry out statistical analyses of Sora Stream accesses, uses and views.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY OF SORA STREAM

Please read and accept this license agreement before installing and using the Sora Stream service. The Ludium application grants its Users a non-exclusive and non-transferable license (hereinafter, the “License”) to use the website and the gaming platform.

By accessing and/or using Sora Stream, the user accepts the Terms of Use of Ludium and executes it at its own risk and responsibility. Ludium reserves the right to update and modify these Terms.

5.1. Copyright

Ludium is the owner of Sora Stream’s trade name, copyright and distribution rights. The copyright includes the “look and feel” of the Ludium software. This agreement is a license to use Sora Stream and Ludium software and does not imply a transfer of ownership of its rights.

In this sense, Ludium by itself or as an assignee, is the owner of all the intellectual and industrial property rights of Sora Stream or the games offered in it, as well as the appearance, style of the software and the elements contained therein (for instance, images, sound, audio, video, software or texts; trademarks or logos, color combinations, structure and design, selection of used materials, computer programs necessary for its operation, access and use, etc.), owned by Ludium or its licensors. Under the provisions of the Copyright Law, the reproduction, distribution and public communication, including its method of making available, of all or part of the contents of, for commercial purposes, in any medium, are expressly prohibited. and by any technical means, without the authorization of Ludium or third owners.

The user agrees to respect the Intellectual and Industrial Property rights owned by Ludium and the owners of the games. Unless expressly authorized, Ludium does not grant any type of license or permission to use in relation to its intellectual and industrial property rights or any other property or right associated with its platform.

The user cannot change, deconstruct, disassemble or decompile the Sora Stream platform, which includes the use of any current or future technology, and must refrain from deleting, altering, evading or manipulating any protection device or security system that was installed in the Ludium application. Failure to comply with any of the terms and conditions of this License will be interpreted as a violation of these Terms of Use.

Failure to comply with any of the terms and conditions of this License will be construed as a violation of these Terms of Use.

5.2. Third Party Applications and Devices

The Ludium Service is integrated or may, in any other way, interact with third-party applications, websites and services and third party devices (“Third Party Applications and Devices”) to make the Ludium Service available to you. These Third-Party Applications and Devices may have their own terms and conditions of use and privacy policies, and your use of these Third-Party Applications and Devices will be governed by and subject to such terms and conditions and privacy policies. The User understands and accepts that Ludium neither subscribes nor is responsible for the behaviors, features or contents of the Third Party Applications or Devices or any legal business that the User may enter into with the provider of any of these Third Party Applications and Devices, nor does Ludium guarantee the compatibility or continued compatibility of Third Party Applications and Devices with the Service.

5.3. Guarantees and responsibilities

You must use the Sora Stream service in accordance with the terms and conditions of this document. Ludium will not be liable for damages derived from the use of Ludium inconsistent with this License. Except for the responsibilities established in the consumer protection rules, the user exonerates Ludium from any responsibility derived from the incorrect execution of Sora Stream or the incorrect operation thereof caused by the way the software was executed. This disclaimer extends to Ludium employees and management.

Ludium states that this License to use the Sora Stream platform does not breach any previous contract or current legislation. Ludium does not guarantee the availability, continuity or flawless operation of the software. Therefore, to the extent permitted by the law, this warranty does not include damage resulting from Ludium’s unavailability or operation and Sora Stream functionality. Ludium does not assume any responsibility in case of an unforeseeable circumstance or force majeure, in the same way, it will not be responsible for any cause that is beyond reasonable control, such as the existence of viruses and the interference of third parties.

5.4. Duration of the License

The validity of this License starts with the acceptance of these Terms of Use. Ludium shall have the right to restrict, suspend or terminate this License at its own discretion, in whole or in part, at any time and for any reason and without prior notice nor responsibility.

Ludium grants only the Sora Stream license to use. In no case grants the license or authorization of distribution of any kind on their copyright and industrial property rights or on any other property or right related to Sora Stream.

6. USE OF THE SORA STREAM PLATFORM

The user commits to make a diligent and responsible use of the Sora Stream platform and not to cause any damage to the physical and logical systems of Ludium, owner of Sora Stream, its suppliers or third parties, to introduce or spread computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage.

The User, holder of the account, does not have permission, nor will grant permission to third parties (with the exceptions imposed by local laws) to:

  • Obtain or try to obtain unauthorized access to the Sora Stream account;
  • Use the Sora Stream account in a tortuous way, for illegal purposes or in any other way that does not respect these Terms of Use or
  • Sell, rent, lease, distribute, transfer, sublicense, reproduce, duplicate, copy, translate, reverse engineer, drive source code from, modify, disassemble, decompile, create derivative works based on, remove any proprietary notices or labels, use for commercial purposes or exploit Sora Stream content or any software accessed via Sora Stream, or
  • Host or provide matchmaking services for the Sora Stream Content, or
  • generate income from the use or supply of the Sora Stream content or Sora Stream account and be for profit or commercial benefit or other purposes, without the prior, express and written consent of Ludium or other legitimate third parties.

7. BRING YOUR OWN LICENSE (BYOL) – THIRD-PARTY CONTENT

Sora Stream may implement a Bring Your Own License (“BYOL”) model, whereby users are permitted to access and use certain software titles, applications, or digital content that they have lawfully acquired from third-party distributors, publishers, or online stores (the “Third-Party Stores”). Under this model, access to and use of any content under the BYOL model is conditional upon the user holding a valid and subsisting license for the corresponding title. Users must provide and maintain their own credentials or verification proving lawful ownership or licensing rights.

Ludium does not charge, retain, or receive any fees, commissions, or payments related to BYOL-enabled access, nor are users required to pay any separate subscription or usage fee to Ludium in relation to such activity.

All rights, terms, and conditions applicable to BYOL content are governed solely by the respective End-User License Agreements (EULAs) and the terms of the relevant Third-Party Stores or publishers. Ludium does not grant, modify, or extend any rights under those agreements.

Users may only access, stream, or play BYOL content through Sora Stream if they comply with all license terms, usage restrictions, and technical requirements defined by the applicable third-party licensors.

Ludium assumes no liability for any loss, suspension, or restriction of access caused by the user’s breach of third-party license terms or by the withdrawal, modification, or unavailability of content from any Third-Party Store.

8. TERMS AND CONDITIONS OF SALE

8.1. Changes to the Agreements

From time to time, we may make changes to the Agreements for legitimate reasons, such as improving existing functions or features or adding new functions or features to the Service, implementing scientific and technological advances and reasonable technical adjustments to the Service, ensuring the operation or security of the Service, and for legal or regulatory reasons. Where we make material changes to the Contracts, we will notify you in a manner that we consider appropriate in the circumstances, e. g, we will display a prominent notice or ask for your consent on the Service or send you an email.

In some cases, we will notify you in advance so that your continued use of the Service after changes are made will signify your acceptance of the changes. Therefore, be sure to read that notice carefully, as well as the new version of the Contracts. If you no longer wish to use the Service under the new version of the Agreements, you may cancel your account by contacting us. In the event that you have received a Trial Subscription Period or a Paid Subscription through a third party, you must cancel the Paid Subscription through such third party.

8.2. Enjoy Sora Stream

Below you will find information about the different options available to enjoy Sora Stream.

8.2.1 Service Options

When you create a Sora Stream account, we will explain the Service options available. Certain options are offered free of charge. Other options require payment before you can access them ("Paid Subscriptions"). We are not responsible for the products and services provided by such third parties. We reserve the right to modify, terminate or otherwise change the offering of our subscription plans, as well as our promotional offers, at any time, in accordance with these Terms and subject to any terms applicable to such plans and offers.

8.2.2 Trial Periods

From time to time, we may offer, or others may offer on our behalf, trials of Paid Subscriptions for a specified time without payment or for a reduced fee (a "Trial Period"). Sora Stream may determine your eligibility for a Trial Period and may withdraw or modify such Trial Period at any time, without notice and without liability, to the extent permitted by applicable law.

8.2.3 Maintenance and Session Termination

To keep the service in optional conditions, we may need to start maintenance periods on our software/hardware without prior notice. During these maintenance periods, we may close your sessions, disable access to Sora Stream or disable some of its functionality, including access to some games. Duration of maintenance periods will be limited to the necessary time to fix the situation and guarantee that Sora Stream can continue running. You acknowledge that you will not ask us for compensation related to the time when Sora Stream is unavailable due to a maintenance period.

In addition, we may also automatically terminate your session when no activity has been detected for a reasonable time (15 minutes). Users are welcome to launch a game immediately after session was closed for inactivity, there is no time penalty for using the service again. This will ensure that servers are available for other active users.

Sora Stream is not liable for any loss or damage arising out of a session termination, unavailability of the Service, including, but not limited to, loss of unsaved data, progress, loss in a tournament, or any negative consequence.

8.2.4 Play Steam Games with your own License

Sora Stream keeps a selection of Steam Games installed and updated on our cloud infrastructure, ready to be played by the User. This selection of games will only be playable if the User owns a license for the game on the Steam platform, and it is the Users’ responsibility to have sufficient rights to play such games. Sora Stream will ask for your Steam credentials to validate your license before launching the game. The Users are responsible for maintaining their own credentials secure for their only use. The Users undertake to comply with all the terms and conditions of the Steam Subscriber Agreement and the End-User License Agreement of Steam Games.

The selection of Steam Games in Sora Stream may vary over time. Not all the content of Steam Games that the User may have license to play may be available to play on Sora Stream infrastructure. Activities, transactions and deals between the User and Steam Games or other content providers are solely between the User and Steam Games or these other content providers. Ludium will not assume any responsibility for any content, or for information, materials, products or services that users receive from other parties or load for use in Sora Stream infrastructure.

By using this service, the User agrees not to use Sora Stream to break any of the conditions of the Steam Subscriber Agreement, nor the End-User License Agreement of owned games. Users also agree not to behave in a manner which is detrimental to the enjoyment of Steam Games’ games. This includes, but it is not limited to, cheating, harassment, use of abusive or offensive language, game abandonment, game sabotage, spamming, social engineering, or scamming.

8.2.5 Play Epic Games with your own License

Sora Stream keeps a selection of Epic Games installed and updated on our cloud infrastructure, ready to be played by the User. This selection of games will only be playable if the User owns a license for the game in the Epic Games platform, and it is the Users’ responsibility to have sufficient rights to play such games. Sora Stream will ask for your Epic Games Store credentials to validate your license before launching the game. The Users are responsible for maintaining their own credentials secure for their only use. The Users undertake to comply with all the terms and conditions of Epic Games EULA and the End-User License Agreement of games of Epic Games.

The selection of Epic Games in Sora Stream may vary over time. Not all the content of Epic Games that the User may have license to play to may be available to play on Sora Stream infrastructure. Activities, transactions and deals between the User and Epic Games or other content providers are solely between the User and Epic Games or these other content providers. Ludium will not assume any responsibility for any content, or for information, materials, products or services that users receive from other parties or load for use in Sora Stream infrastructure.

By using this service, the User agrees that not to use Sora Stream to break any of the conditions of the Epic Games EULA, nor the End-User License Agreement of owned games. Users also agree not to behave in a manner which is detrimental to the enjoyment of their Games. This includes, but it is not limited to, cheating, harassment, use of abusive or offensive language, game abandonment, game sabotage, spamming, social engineering, or scamming.

8.3. Payments, cancellations, right of withdrawal and refund policy
8.3.1 Billing

You may purchase a Paid Subscription directly from Sora Stream in accordance with your Service Plan model. Sora Stream may change the price of Paid Subscriptions, including recurring subscription fees, at any time. Most recurring subscriptions will renew automatically when your current subscription period ends if you do not cancel the subscription. If you do not want to renew your subscription, you should unsubscribe before it expires. Price changes will apply at the start of the next subscription period following the date the price change is made. To the extent permitted by applicable law, your continued use of the Sora Stream Service after the price change takes effect will constitute acceptance of the new price. If you do not agree with the price change, you have the right to reject the change by unsubscribing from the Paid Subscription before the price change becomes applicable.

If you purchase a Paid Subscription, you authorize Sora Stream to automatically charge you each month until you cancel. In case of payment failure (e.g. you don’t have enough money in your bank account, or your card is temporarily blocked), system may withdraw funds from you multiple times until payment is successfully completed. The right of withdrawal and its applicable conditions are set out in Section 8.3.3 below. The applicable refund policy is set out in Section 8.3.4 below.

When your subscription ends, you will have access to your user account, but your access to gaming content will be limited (e.g. you may be able to see the game catalogue, but you will not be able to launch video games using Sora Stream).

We may provide discounts, free trials and other means to access Sora Stream via promotional codes. Duration of discounts and free trials will be specified alongside the promotion. They will typically offer a discounted price during the first subscription period, which will be one week, one month or one year depending on the promoted subscription plan. In case of free trials, the discount will compromise the totality of the subscription period. Afterwards, subscription will be renewed at the price stipulated at registration time. In case of free trials, neither refund nor compensation will be issued to you. In case you obtained these promotions from a third-party website, any relevant rules and agreements of the third-party distributor will be applicable to your purchase of Sora Stream.

You are responsible for the security of your bank cards and payment details you use to make transactions on Sora Stream. Claims relating to unauthorized charges shall be handled in accordance with the procedure set out in Section 8.3.4.1(c).

8.3.2 Renewal; Cancellation

Payment paid to Sora Stream will automatically renew at the end of the relevant subscription period, unless you cancel the Paid Subscription before the end of the relevant subscription period. The cancellation will take effect from the day following the last day of the current subscription period.

8.3.3 Right of Withdrawal

In accordance with applicable law, where the user qualifies as a consumer, they shall have the right to withdraw from the contract within fourteen (14) calendar days from the date of purchase. The right of withdrawal may be exercised by sending an unequivocal written notice to legal@ludiumlab.com within such fourteen (14)-day period. In that event, Ludium shall reimburse all payments received from the user within fourteen (14) calendar days from receipt of the withdrawal notice, using the same means of payment originally used for the transaction, unless otherwise expressly agreed.

However, the right of withdrawal shall not apply once performance of the Service has begun. As Sora Stream provides access to digital content and digital services not supplied on a tangible medium, performance shall be deemed to begin when the user is granted access to the Service or is otherwise enabled to access or use any digital content made available.

8.3.4 Refund Policy

Once the right of withdrawal has been waived in accordance with Section 8.3.3, or once the fourteen (14) calendar day withdrawal period has expired without the User having exercised such right, no refunds shall be issued except in the limited circumstances expressly set out in this Section.

8.3.4.1 Circumstances giving rise to a refund

The following situations shall entitle the User to a refund in given circumstances:

  1. Duplicate or erroneous charges. If Ludium’s payment system processes a charge in error or duplicates a payment, Ludium shall fully refund the affected amount within ten (10) business days following verification of the error.
  2. Charges processed after effective cancellation. If Ludium processes a charge after the User has duly cancelled the Paid Subscription in accordance with Section 8.3.2, Ludium shall fully refund the amount corresponding to the period following the effective cancellation date.
  3. Unauthorized charges. If a payment has been processed without the User’s authorization, the User may report it to Ludium at legal@ludiumlab.com and to the relevant payment provider. Ludium shall investigate and, if the charge is confirmed as unauthorized, shall issue a full refund.
  4. Unilateral material changes to the Terms of Use or pricing. If Ludium makes a material change to these Terms of Use, the pricing structure, or the core features of the Service in accordance with Section 8.1, Users who do not accept such changes shall be entitled to cancel their subscription before the changes take effect. In that case, any pre-paid amount corresponding to the period after the effective date of the changes shall be refunded on a pro-rata basis. Changes to the Terms of Use or pricing shall only take effect from the next billing period onwards.

8.3.4.2 Circumstances that do not give rise to a refund

The following situations shall not entitle the User to a refund under any circumstances:

  1. Failure to cancel the Paid Subscription before its automatic renewal date.
  2. Use of the Service during the billing period for which the refund is requested, regardless of the intensity or frequency of such use.
  3. Technical issues that are isolated, intermittent, or temporary in nature, including those experienced during a single session or over a limited period, and that do not constitute a persistent and systemic failure of the Service attributable to Ludium.
  4. Performance issues arising from the User’s own equipment, internet connection, or failure to meet the minimum technical specifications published by Ludium for the proper use of Sora Stream.
  5. Subjective dissatisfaction with the Service, including personal preferences regarding the game catalogue, perceived streaming quality, individual gameplay experience, latency attributable to network conditions beyond Ludium’s control, or any other assessment based on the User’s individual expectations.
  6. Billing periods that have already elapsed in full at the time the refund request is submitted.
  7. Service unavailability resulting from scheduled or emergency maintenance periods as described in Section 8.2.3.
  8. Any other circumstances not expressly recognized as refundable under Section 8.3.4.1 or under applicable consumer protection legislation.

8.3.4.3 Cancellation and refunds

The cancellation of a Paid Subscription does not in itself entitle the User to a refund. Upon cancellation, the User shall retain access to the Service until the end of the current billing cycle, after which access to paid content will be deactivated. No partial or pro-rata refund shall be issued for the remaining days of the billing cycle in which the cancellation takes effect, except where otherwise required by applicable law.

8.3.4.4 Refund request procedure

All refund requests must be submitted in writing to legal@ludiumlab.com. The request must include the User’s account details, a description of the grounds on which the refund is claimed (limited to those set out in Section 8.3.4.1), and any relevant supporting documentation. Ludium shall review and respond to each request within ten (10) business days. Refunds, where applicable, shall be processed using the same payment method originally used by the User.

Nothing in Section 8.3.4 shall be construed as limiting or excluding any mandatory rights afforded to consumers under applicable law.

8.4 Age and Eligibility Requirements
8.4.1 Minimum Age for Contracting

The contracting of any Paid Subscription or the purchase of any service through Sora Stream is exclusively reserved to natural persons who are at least eighteen (18) years of age and who possess full legal capacity to enter into binding agreements. Any subscription contracted by a person under eighteen (18) years of age without the intervention of a parent or legal guardian shall be voidable at Ludium's discretion, without prejudice to any other rights or remedies available to Ludium under applicable law.

8.4.2 Use of Sora Stream by Minors

Minors under eighteen (18) years of age may use the Sora Stream platform exclusively under the following conditions:

  1. A parent or legal guardian must have previously contracted the Service and accepted these Terms of Use on the minor's behalf.
  2. The parent or legal guardian must expressly authorize the minor's use of the platform and shall assume full and exclusive responsibility for such use, including, without limitation, compliance with these Terms of Use, the applicable Privacy Policy, and any applicable laws and regulations.
  3. The parent or legal guardian shall exercise adequate supervision and control over the minor's use of Sora Stream, including the type of content accessed, the duration of use, and any interactions with other users or third-party services.
  4. The parent or legal guardian shall be jointly and severally liable with the minor for any breach of these Terms of Use, any damages caused to Ludium or to third parties, and any purchases, subscriptions or transactions carried out through the minor's account or in connection with the minor's use of the Service.

8.4.3 Age Verification

Ludium reserves the right to request, at any time and without prior notice, proof of age or legal capacity from any User or from the parent or legal guardian of a minor User.

Acceptable proof may include, without limitation, a valid government-issued identification document or any other means of verification that Ludium deems appropriate. Failure to provide satisfactory proof of age or legal capacity within a reasonable timeframe shall entitle Ludium to immediately suspend or terminate the User's account and access to the Service, without liability and without prejudice to any other rights or remedies available to Ludium.

8.4.4 Age-Restricted Content

Certain video games accessible through Sora Stream are intended exclusively for users aged 18 or over. Such games may include content that some individuals may find sensitive, including, without limitation, scenes of violence, strong language, or mature themes. Users agree to access and play these games responsibly. Where a minor is authorized to use the platform, the parent or legal guardian shall be solely responsible for monitoring and restricting the minor's access to age-restricted content. Ludium shall not be liable for any exposure of a minor to age-restricted content where the parent or legal guardian has failed to exercise adequate supervision.

9. DATA PROTECTION

Ludium complies with the General (EU) 2016/679 Data Protection Regulation (hereinafter, "GDPR"), the Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights (hereinafter, "LOPDGDD") and other regulations that may always be in force and ensures the correct use and processing of the user’s personal data. Therefore, each time the user accesses and uses Sora Stream, must accept the Terms of Use and the Privacy Policy, which informs about who the identity of the Data Controller, its address, the possibility of exercising the data protection rights of access, rectification , erasure, opposition and revocation of consent by sending an e-mail to privacy@sorastream.com, as well as the purpose of the processing and data communications to third parties, where appropriate, to be able to use the Sora Stream platform and play. Ludium may use personal data to send or make commercial or promotional communications to Sora Stream users who have given their prior consent.

10. EXCLUSION OF GUARANTEES AND LIABILITY

Ludium reserves the right to cancel the access of a user to Sora Stream, as well as all or part of the content provided through it, at any time and without prior notice, for technical reasons, security breaches, maintenance or power failures or any other reasonable cause. Consequently, Ludium does not guarantee the integrity, availability or continuity of the Sora Stream platform or its content, therefore, its use is made at the User’s own risk and Ludium is not responsible for the discontinuity or unavailability of this service.

Ludium is not liable for any interruption of Sora Stream services, delays, errors, malfunctions and, in general, any other problem arising from causes beyond Ludium’s reasonable control and/or related to willful misconduct or intent, fault or negligence of the users, and/or due to force majeure. Force majeure is defined as all those events that go beyond Ludium’s reasonable control, such as: third parties’ errors, operators or service companies, acts of the government, lack of access to third party networks, acts or omissions of public authorities, or those produced as a result of natural disasters, blackouts, attacks by hackers or other third parties to the security or integrity of the system. In any case, whatever the cause, Ludium will have no liability for direct or indirect damage or for losses incurred.

All liability of Ludium is excluded for damage of any kind that may result from the presence of viruses or the presence of other harmful elements in the content that may cause alterations in the computer systems, as well as in documents or other systems stored in Sora Stream. Ludium is not responsible, in any case, for damages of any nature that may cause, for instance, errors or omissions in the contents, unavailability of Sora Stream’s service or the transmission of viruses or malicious or harmful programs in the contents, despite having taken all the necessary technological measures to avoid it. Ludium will pursue the breach of these conditions as well as any improper use of the Sora Stream service, exercising all civil and criminal actions that may be applicable by law.

11. MODIFICATION OF THESE TERMS AND DURATION

Ludium reserves the right to make the modifications it deems appropriate in Sora Stream without prior notice, being able to change, delete or add both the content and services provided through it and the way in which they are presented or located in the Sora Stream platform. The validity of the aforementioned terms of use will be based on their exposure and will be in force until they are modified by others duly published. These Terms of Use and, therefore, the License, will end the moment the user incurs a violation of them. You must remove any copy of the Ludium software in your possession at the time of termination of these Terms of Use.

12. RIGHT OF EXCLUSION

Ludium reserves the right to deny or withdraw access to Sora Stream and/or the services offered without prior notice, at its own request or by a third party, to those users who fail to comply with these Terms of Use.

13. APPLICABLE LEGISLATION AND JURISDICTION

The User expressly accepts that all disputes, claims and other issues that may arise or are related to the Sora Stream service will be governed by current Spanish regulations and any controversy will be submitted to the Courts of the city of Barcelona, unless the regulations for the consumers and users' protection establish other criteria.
